1. INTRODUCTION
1.1. Preamble
Infinity Hash Limited (“Company,” “we,” “our,” or “us”) is a company duly organized and existing under the laws of Hong Kong (BRN: 77357234), with its registered address at World Trust Tower, 50 Stanley Street, Central, Hong Kong. We offer access to Bitcoin mining capacity through our digital platform (the “Platform”, “Website” or “Dashboard”). Any individual or corporate entity accessing our infrastructure, Platform, or utilizing our services shall collectively be referred to as the “Customer” (or “Customers”). Customers may purchase mining power in the form of SHA-256 hash rate (H/s), which may yield daily mining rewards from our mining pool.
Our Customers include individuals and entities who access our infrastructure and services through our dashboard. Our business is of a cross-border nature; hence, its Customers are based across the world. These Terms of Service (“Terms”) govern the Customer's access to and use of our services. By using our services, the Customer agrees to be bound by these Terms.
The Customer's use of the Platform is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
1.2. Legal Framework
These Terms are governed by the laws of Hong Kong, including but not limited to the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615). We reserve the right to update these Terms in compliance with any legal or regulatory changes.
The company understands that the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap. 615) imposes substantive legal obligations that are not necessarily connected directly with Customer due diligence and apply to all businesses. Accordingly, the Company maintains and enforces a comprehensive internal AML/CFT compliance and employee training program.
2. SCOPE OF SERVICES
2.1. Services We Provide
The Company provides a simple solution via our dashboard that allows private individuals and corporate Customers to purchase Bitcoin mining hash rate generated by real, physical hardware ASIC miners, and to utilize that hash rate within data centers contracted by the Company through third-party hosting providers. The hash rate is offered in the form of SHA-256 hash rate (H/s), which may generate daily mining rewards from the company’s mining pool.
The purchase of hash rate constitutes the rental of actual computational capacity in specific, real hardware ASIC miners for the duration of the term, subject to these Terms, and the receipt of digital assets generated by that specific power. The purchase of this capacity applies exclusively to operations conducted via the Company and its third-party hosting providers. The Customer cannot sell, rent out, or otherwise physically dispose of the mining hardware associated with their purchased hash rate. For IT security and general safety reasons, direct physical access to the hardware is not possible. However, Customers are provided with full transparency via their dashboard account, where rewards, electricity costs, and mined BTC are displayed daily, and where individual settings can be adjusted.
This service does not constitute a financial investment, security, or collective investment scheme. Customers bear the sole risk that the value of the digital assets mined may be less than the cost of the hash rate. Additionally, we facilitate the automated withdrawal of mining rewards.
2.2. What We Are Not
The Company does not operate as a cryptocurrency exchange and does not provide any banking or financial services. Additionally, we do not function as a traditional Bitcoin mining hosting provider, as our mining power is sourced through contractual agreements with third-party hosting providers.
Furthermore, the Company does not offer custody or management services for crypto assets on behalf of Customers. The Company does not hold Bitcoin in custody for Customers and does not possess or have access to the Customer's private keys. Customers are solely responsible for the independent custody and storage of their crypto assets. Customers can check their mining rewards in their dashboard account at any time.
2.3. No Guarantee of Mining Rewards
While we endeavor to provide consistent mining rewards, we make no guarantee regarding the exact amount or frequency of rewards. The mining rewards are subject to factors beyond our control, including fluctuations in Bitcoin network difficulty, algorithmic changes, protocol updates (including 'halving' events), changes in mining conditions, and the financial stability of third-party hosting providers. In the event of bankruptcy or other financial distress affecting a third-party hosting provider, the Company assumes no liability. Furthermore, we shall not be held responsible for disruptions caused by force majeure events, including but not limited to regulatory changes, natural disasters, or cyberattacks.
2.4. Term, Profitability, and Hardware Lifecycle
The term of the hash rate rental is open-ended and shall commence upon the successful installation and operational deployment of the applicable mining hardware within the data center. For the purposes of these Terms, an open-ended term dictates that the purchased hash rate remains active strictly on the condition of sustained profitability, requiring that the generated mining rewards continuously exceed the combined sum of applicable electricity costs and pool fees. Consequently, the operational lifetime of the mining capacity is wholly contingent upon this profitability threshold and remains subject to the following economic and operational termination conditions, with no minimum operating period guaranteed:
- Automatic Offline/Online Status: If a specific hardware miner generating the purchased hash rate ceases to be profitable, that hardware – and consequently, its associated hash rate capacity – will automatically be taken offline. The hardware may be brought back online should profitability return; however, no guarantee is provided regarding the timeframe for reactivation. The reactivation schedule is strictly contingent upon the operational capacity and procedures of the third-party data centers, which may entail physical reconnection, system health diagnostics, and any necessary maintenance, cleaning, or repairs required following the period of inactivity.
- Hardware Retirement: If a hardware miner remains continuously unprofitable for a period of three (3) consecutive months, the physical unit – and consequently, its associated hash rate capacity – shall automatically be deemed retired and will not be brought back online, unless the Company decides otherwise at its sole discretion as a gesture of goodwill.
- Hosting Terminations: If a third-party hosting provider terminates its contract with the Company or is otherwise unable to provide services to the Company, both the Company and the Customer are entitled to terminate the hosting service for good cause with immediate effect.
- Hardware Disposal: Upon the conclusion of the term (including hardware retirement), the Company assumes the costs for the disposal of the mining hardware. The Customer has no further claims against the Company regarding the hardware or its disposal.
3. AFFILIATE PROGRAM
3.1. Commission Structure
The Company operates an affiliate program through which Customers may receive commissions for referring new Customers to our platform. These commissions are paid exclusively from our designated marketing budget and are not derived from other Customers' funds or mining rewards. We retain the absolute right to modify, suspend, or terminate the affiliate program at our sole discretion. Any attempt to abuse, manipulate, or engage in fraudulent activity within the affiliate system may result in the immediate termination of the Customer’s account without prior notice.
4. ELIGIBILITY & ACCOUNT REQUIREMENTS
4.1. Eligibility Criteria
To be eligible to use our services, an individual or corporate entity must meet certain conditions. Customers must be at least 18 years of age and must not be residents or entities in any jurisdiction listed in Section 4.2 (High Risk & Prohibited Countries List). By accessing our platform, Customers explicitly agree to these Terms of Service. Should a Customer attempt to access our services from a prohibited jurisdiction or provide false information during registration, we reserve the right to immediately terminate their account and report the violation to the Joint Financial Intelligence Unit (JFIU) of Hong Kong, as well as other relevant legal authorities.
4.2. High Risk & Prohibited Countries List
Customers are strictly prohibited from accessing or using our services if they are residents or entities prohibited under the OFAC sanctions programs or Hong Kong’s sanctions list (based on UN sanctions), or individuals on OFAC’s Specially Designated Nationals and Blocked Persons List (“SDN List”). Additionally, residents or entities in Hong Kong are restricted from using our services due to regulatory reasons, not sanctions.

- Hong Kong (restricted due to regulatory reasons, not sanctions)
- Iran
- Libya
- North Korea
- Somalia
- South Sudan
- Sudan
- Syria
- The Crimea Region of Ukraine
- The Donetsk People’s Republic (DNR) region of Ukraine
- The Luhansk People’s Republic (LNR) region of Ukraine
- Yemen
The Company will not establish business relationships with any Customers located in such countries, including entities organized, operating from, or beneficially owned by persons located in such countries.
5. CUSTOMER RESPONSIBILITIES
5.1. Prohibited Activities
Customers of our platform are strictly prohibited from engaging in any form of illegal, fraudulent, or unethical activity. This includes, but is not limited to, money laundering, misrepresentation of personal or corporate identity, abuse of the affiliate program, or any attempt to manipulate the platform’s operations. Any Customer found to be participating in such activities may have their account permanently terminated and may be reported to relevant authorities.
5.2. One Account Only
Each individual person or legal entity may register and maintain only one account. Duplicate, multiple, or proxy accounts under a single individual or entity are explicitly prohibited. In the event multiple accounts are identified, we reserve the right to suspend or terminate all associated accounts and to withhold any associated mining rewards.
6. FEES & PAYMENTS
6.1. Pricing & Payment Methods
Customers may purchase mining hash rate through various third-party payment providers authorized by the Company. Maintenance, repair, and infrastructure costs are fully included in the purchase price of the hash rate. We do not engage in direct fiat-to-cryptocurrency exchanges. All transactions conducted through our platform are final, and Customers acknowledge that refunds will not be provided unless legally mandated. The Company reserves the right to modify its pricing structure and available payment methods at its sole discretion and without prior notice.
6.2. Withdrawal of Mining Rewards
Mining rewards are automatically withdrawn to the cryptocurrency wallet designated by the Customer. Withdrawals of mining rewards are subject to withdrawal thresholds, applicable transaction fees, compliance checks, and additional conditions set forth by the Company. The Company reserves the right to determine and adjust these withdrawal thresholds and related settings at its discretion. As the Company does not provide custody services, funds are not retained on the platform beyond what is required for automated withdrawal processing. All withdrawals may be subject to applicable network and transaction fees, which will be deducted at the time of processing. Furthermore, mining reward withdrawals may undergo compliance checks in accordance with AML and CFT regulations, which could result in additional processing time. We reserve the right to reject or delay withdrawals if suspicious activity is detected.
6.3. Taxes
Customers are solely responsible for determining what, if any, taxes apply to their purchase of hash rate and the receipt of mining rewards. The Company does not provide tax advice, nor are we responsible for collecting, reporting, withholding, or remitting any taxes arising from the Customer's use of the Services.
7. LIMITATION OF LIABILITY
The Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to the use of our services. This includes but is not limited to financial losses, lost profits, data breaches, or service disruptions. Customers acknowledge that the mining industry involves inherent risks, including regulatory changes, market volatility, and operational failures. The Company does not assume responsibility for losses incurred due to these factors.
8. ACCOUNT TERMINATION & SUSPENSION
The Company reserves the right to suspend or terminate any Customer account at its sole discretion. This may occur in cases where a Customer violates these Terms of Service, fails to comply with our KYC requirements, provides false or misleading information, or engages in any form of fraudulent, unlawful, or unethical behavior. In cases of serious violations, we may also report the matter to appropriate law enforcement or regulatory agencies.
9. AMENDMENTS & MODIFICATIONS
We may update these Terms from time to time. Changes will be posted on our website, and continued use of our services by the Customer constitutes acceptance of the revised Terms.
10. SALVATORY CLAUSE
If any provision of these Terms is held to be invalid, illegal, or unenforceable (in whole or in part) under applicable law, the invalidity, illegality, or unenforceability shall not affect the remaining provisions (or parts thereof) of these Terms, which shall remain in full force and effect. The parties agree that any invalid, illegal or unenforceable provision shall be replaced by a valid provision which comes closest to the intention of the original provision, where permitted by law.
11. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of Hong Kong. Any disputes arising out of or in connection with these Terms shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.
